Our smokers denied blocking but were observed to block during the last few puffs when the cigarette was difficult to grasp without covering ventilation holes. You are fully familiar with all of the efforts which we as a company and which this Region and the EEMA Region have exerted in order to attempt to ensure that the BARCLAY brand cigarette is accurately measured for "tar" and nicotine and that the correct readings of "tar" and nicotine be available to consumers through brand advertising and package markings so that consumers have a uniform basis of comparison of cigarette brands on the market place.

Should we on a worldwide basis or on a selected geographical basis seek to have applicable cigarette testing norms changed so as to have adopted a method which will accurately test the BARCLAY-type filter? What are the advantages and what are the disadvantages and risks of attempting to do this and, in the end, do you recommend that we proceed on this basis? Would we be able to overcome in practice any opposition by B.A.T. (and perhaps of others), to such an objective? Do we risk and if so can we control the problem of "opening Pandora's box" of other problems? How "quietly" can any attempt to change international or local norms and related laws be made, so that undesirable public interest (including so-called anti-smoking groups) is not aroused which might result in unfavourable publicity for the industry (or for us in particular) and which could give such interested parties an opportunity to seek and perhaps to obtain severe and undesirable changes to internationa1 or local norms and related laws?

Before Barclay, no cigarette consistently produced a significant difference in dilution and therefore in "tar" depending upon whether it was smoked in the FTC smoking machine or by a human being. Thus, until now, there has been a reasonable basis for accepting the results of testing "by FTC method" as a fair reflection of the relative ranking of cigarettes in terms of "tar" and nicotine deliveries.

What are the risks of going ahead as outlined in this memorandum? Basically the following things could happen:
- BAT'could put up enormous resistance by pointing out that the presently employed standard smoking procedures are irrelevant and inapplicable for the description of product performance, that an entirely new system, would have to be found, the physiology of the human body as well as the behaviour of smokers has to be taken into, consideration, etc.

The meeting of the CORESTA task force dealing with the testing of channel ventilated cigarettes took place in London at BAT HQ on June 22, 1989. As foreseen, BAT admitted that, based on recent studies, Barclay is not a 1mg product and that it would be fairly "ranked" at 5mg (example given for the Swiss Barclay version). This statement was very well received by the participants and it was the general opinion that there are no longer any major restrictions to having a method accepted at the next CORESTA meeting in Interlaken.

Recent problems (e.g. Barclay) have shown that in many countries it is preferable to solve technical or scientific problems through international organizations instead of trying to find a solution at a;local/national level. The main disadvantage of arguing with local authorities is that it is very difficult to find technically competent people and/or that we often have to face the anti-smoking lobby and the debate then becomes emotional. On the other hand, if a "precooked" solution is proposed by a credible international organization it is often accepted "as is" because of the fear of going against international trends.
There are two international organizations which are controlled by the Industry: CORESTA and ISO (International Standards Organization) [...]. For the past twenty years these two organizations have been workingon minor problems of ineasuringtechniques but they have shown their ability to deal effectively with a major legal/commercial/technical issue such as channel ventilation,, if pushed and directed correctly.
CORESTA [...] is 100 % controlled by the Industry [...]. Representation within the ISO technical committee 126 is made up of approximately 80 % Industry [...].
The best way to work with these two organizations is to do a11 the technical work within CORESTA and then have it endorsed by ISO. So far, all the testing methods developed by CORESTA were approved by ISO with only minor modifications.

- Participated in various Task Force assignments to evaluate various holder modifications for smoking channel ventilated cigarettes. None of those studied were acceptable, but all indicated that channel ventilated cigarettes were not being measured properly by standard holder. Very strong feelings between BAT (B&W) and PM.
- Sudden behind the scenes agreement between BAT and PM that Swiss Barclay is a 5 mg product (instead of 1 as measured by standard smoking procedures).
- Philip Morris Neuchâtel fabricated washers and cigarette holders for collaborative study to include channel ventilated cigarettes. Washers designed to restrict Barclay filter channels to provide 5 mg yield. Collaborative study showed no effect on tar yield of regular filter cigarettes but confirmed 5 mg yield for Barclay.

Neither CORESTA nor its member companies maintain that cigarette mainstream smoke yields determined by the standard smoking methods are necessarily predictive of yields created by individual consumers. This is an impossible task. Smokers not only smoke individual brands differently, but they also smoke the same brand differently depending upon a host of human and environmental variables. The concept of a standard smoking method representing all smokers, products, and conditions is ingenuous. In a situation precisely analogous to gas mileage certification for motor vehicles, annualized appliance energy consumption labels, food caloric content, tire wear mileage certification, paint coverage labeling, etc., no consumer expects or should expect to obtain the exact result found by a standard test. Likewise, rankings developed from standard smoking method results give the consumer qualitative guidance in relative cigarette mainstream smoke yields of dry particulate matter, nicotine, and carbon monoxide, but are necessarily predictive of absolute product performance, under all circumstances.

We believe that the FTC method provides a well established basis for measuring and comparing the relative yields of cigarette brands and styles under standardized conditions, and that the communication of FTC method yields to consumers for the last 25 years has provided them with objective information regarding the various cigarette brands available on the market, which they have used to make individual choices about the brands and styles they wish to smoke.
[...] the FTC method was developed through the cooperation of the scientific community, the tobacco industry, the Department of Agriculture, and the FTC. The common goal was to establish a fair, objective, and reproducible methodology for collecting and measuring product characteristics that are not easily measured. [...] And to assure objective and reproducible data, the cigarette must be smoked in a standardized manner, and there must be a standardized way of measuring the smoke created. This is no different from saying that to assure objective and reproducible mileage data, an automobile engine must be operated in a standardized manner and measured in a standardized way by the EPA.
Philip Morris believes that because the FTC method has been and remains a validated and consistent system for providing information to consumers, it should be maintained.
We note that countries around the world, including all government operated testing laboratories in the European Union, are moving to a uniform testing methodology based on the FTC method and endorsed by the International Organization for Standardization ("ISO"). If there were to be any change in the FTC method, the most reasonable change would be the adoption of the strict ISO method. The ISO method is largely identical to the existing FTC method, and the yields measured are comparable.
Individual smokers understand that their actual "tar" and nicotine intake depends on a number of factors, including the number of cigarettes smoked, the number of puffs taken on each cigarette, and the extent to which the smoke is inhaled. FTC "tar" and nicotine ratings do not tell and are not intended to tell individual consumers anything about those factors. But given the inherent variability of those factors -- both among consumers, and for an individual consumer at different times and in different circumstances -- it is difficult to posit a workable alternative to the FTC method that would be more useful and informative.

The earliest patent we have located was granted in 1889, which covered a cigarette having minute perforations in the cigarette paper distributed throughout its length (U.S. 939,004). We recommend that the Board approve the expenditure of approximately $7,000,000 to purchase machinery to enable Philip Morris U.S.A. to use perforated tipping on all filter brands not now ventilated. This program will give us the capability to better control and reduce the tar and nicotine delivery of our products.

In addition, in June of this year the FTC is expected to begin reporting the carbon monoxide (CO) content of cigarette smoke by brand. At this time ventilation through perforated tipping is the only effective means of reducing CO delivery. We feel we must be able to control CO to position our brands competitively and to respond quickly to any public reaction that may develop over CO.

Although equipment for this program will cost approximately $4,500,000, we feel the capital expense to do it in-house is justified for the 'following'reasons:

  1. Flexibility - In-house capability will allow us to vary our dilution levels at will. We will not be bound by suppliers' capacity, capability (or lack of it), and inventory.
  2. Competitive Advantage - We feel it is important to keep any moves we make in this area secret for as long as possible. Any order we place for perforated tipping for Marlboro would be impossible to disguise and would tip our hand to our competitors.
  3. Proprietary Secrets - Our current research into perforated tipping has yielded significant results. Our electric perforating process is truly invisible. This and other proprietary developments must be kept in-house and secret if they are to be a significant competitive advantage.

PRODUCT OBJECTIVES Except for the UK and Germany, the objectives are to standardize smoke deliveries throughout Europe at 18 mg DPM, with the relative reduction in smoke nicotine and, at the same time, to prepare ourselves to get lower than 18 mg DPM if necessary. In achieving these objectives, the existing Marlboro taste profile will be maintained.

During the last 10 years, smoking pattern data have been recorded from several hundreds of smokers in Southampton. No smoker has yet been observed who smokes with the same pattern as a smoking machine. For the purpose of this discussion and on, the basis of the standard machine smoked deliveries, compensation may be defined as:
"Subconscious changes made to the smoking pattern, by a smoker in an attempt, which may or may not be successful, to equalise the deliveries of products which have different deliveries when smoked by machine under standard conditions".
